Terms of Service

1. Acceptance of Terms

By downloading the BGSA Caddy app, visiting bgsa-golf.co.za, or placing an order in our online shop, you agree to these Terms of Service ("Terms"). If you do not agree, please do not use the Service. These Terms are governed by the laws of the Republic of South Africa, including the Consumer Protection Act 68 of 2008 ("CPA") and the Electronic Communications and Transactions Act 25 of 2002 ("ECTA").

2. The Service

• BGSA Caddy mobile app — GPS distances, AI caddy recommendations, scoring, and post-round analysis. Core features are free; the Pro Caddy subscription unlocks advanced AI and analytics.
• BGSA Golf website (bgsa-golf.co.za) — information, pricing, support, and the equipment shop.
• Online equipment shop — driver heads, shafts, grips, golf balls, putters, wedges, and custom-printed/engraved items.

3. AI Caddy Disclaimer

The AI Caddy feature provides club recommendations, distance estimates, and strategic suggestions for informational purposes only. Recommendations are based on available data and AI inference — they are not professional coaching advice. All golfing decisions, including club selection, remain entirely your own responsibility. BGSA Golf accepts no liability for any outcome, score, injury, or damage resulting from following or not following Caddy's suggestions. On-course rules decisions should always be confirmed with your playing partners or a qualified rules official.

4. User Accounts

• You must be 18 years or older to create an account and make purchases.
• You are responsible for maintaining the confidentiality of your account credentials.
• You may not share your account or use another person's account without permission.
• We reserve the right to suspend accounts that violate these Terms.

5. Subscriptions

• Pro Caddy subscriptions are billed monthly or annually via Paystack.
• Subscriptions auto-renew at the end of each billing period unless cancelled.
• You may cancel at any time via the app or by emailing support@bgsa-golf.co.za. Access continues until the end of the paid period.
• We reserve the right to change subscription prices with 30 days' notice. Existing subscribers are unaffected until their next renewal.
• Refunds on subscription fees are at our discretion except where required by the CPA.

6. Shop — Ordering & Payment

• All prices are displayed in South African Rand (ZAR) and exclude VAT unless otherwise stated.
• An order is confirmed once payment is received and you receive a confirmation email.
• We reserve the right to cancel orders for out-of-stock items. A full refund will be issued within 3 business days.
• Payment is processed by Paystack (card payments). We do not store card details.
• Orders are subject to stock availability at time of confirmation.

7. Delivery

• Standard delivery throughout South Africa: R120 flat rate, 3–5 business days.
• We use reputable courier services. A tracking number will be emailed once your order is dispatched.
• Delivery times are estimates only and may be affected by public holidays, remote areas, or courier delays.
• Risk of loss passes to you on delivery.

8. Returns & Refunds

In accordance with the Consumer Protection Act: Standard products: You may return unused, undamaged items in original packaging within 14 days of receipt for a full refund. Contact support@bgsa-golf.co.za to initiate a return. Return shipping costs are your responsibility unless the item is defective or incorrectly supplied. Customised products: Items with laser engraving, ball printing, or other custom personalisation are non-refundable once production has begun, except where the product is defective. Defective products: If a product is defective, you may return it within 6 months of purchase for a replacement or full refund. We will cover return shipping costs for confirmed defects.

9. Intellectual Property

All content on the Service — including the app code, website design, graphics, text, and the BGSA Caddy brand — is owned by BGSA Golf or its licensors. You may not copy, reproduce, or distribute it without written permission. Your personal data (round history, scores, handicap records, and order history) belongs to you. You grant us a limited licence to process this data solely to provide the Service.

10. Prohibited Conduct

• Attempting to reverse-engineer, decompile, or extract source code from the app.
• Using the Service to transmit spam, malware, or any unlawful content.
• Impersonating another person or misrepresenting your affiliation.
• Scraping, crawling, or systematically extracting data from the Service without permission.

11. Limitation of Liability

To the maximum extent permitted by South African law, BGSA Golf's total liability for any claim arising from use of the Service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, consequential, or incidental damages, including loss of profit, data loss, or personal injury arising from use of the Service. Nothing in these Terms limits liability for death, personal injury caused by negligence, or fraud.

12. Changes to the Service

We may modify, suspend, or discontinue any part of the Service at any time with reasonable notice. We will provide at least 30 days' notice for material changes that affect paid subscriptions.

13. Dispute Resolution

We aim to resolve disputes amicably. If you have a complaint, email info@bgsa-golf.co.za. If we cannot resolve a dispute within 30 days, it may be referred to the National Consumer Commission or the relevant small claims court in South Africa. These Terms are governed by and construed in accordance with the laws of the Republic of South Africa.
